Labor Inspections 2025: New Rules, Greater Risks, and Opportunities to Prevent

Is your company prepared to face a labor inspection in Mexico in 2025?

With the recent publication of the Lineamientos Operativos de Inspección 2025 by the Ministry of Labor and Social Welfare (STPS), Mexican authorities are reinforcing their monitoring strategy to ensure compliance with labor regulations, with a more technical, systematic approach, and above all, with greater interinstitutional coordination.

What changes from now on?

Starting March 1, 2025, STPS will implement a new operational model that transforms the federal inspection process in workplaces. These changes have direct implications for employers, especially those receiving foreign investment or being part of global production chains.

Key aspects include:

  • More targeted and systematic inspections, based on compliance history, type of activity, and citizen or union complaints.
  • Monthly and random monitoring through the Support System for the Inspection Process (SIAPI), which will allow authorities to identify non-compliance patterns and prioritize high-risk workplaces.
  • Special focus on occupational safety and health, including immediate visits when fatal accidents occur or imminent risks to workers are detected.
  • Increased scrutiny on subcontracting schemes, particularly for companies registered in the REPSE, where non-compliance could result in the cancellation of their registration.
  • Enhanced interinstitutional coordination: STPS’s observations can now be shared with the SAT, IMSS, and INFONAVIT, multiplying the potential fiscal, financial, and reputational impacts.

What does this mean for your company?

These new guidelines not only tighten compliance but also make inspection processes more predictable and traceable. However, this also means that mistakes or non-compliance will be detected faster, and the consequences can be severe: fines of up to 50,000 times the UMA per violation, multiplied by the number of affected workers, along with additional sanctions such as suspension of activities or loss of registrations.
